ACCC Broadband Speed Claims Industry Guidance

ACCAN recently submitted to the ACCC’s review of the Broadband Speed Claims Industry Guidance. The guidance advises retailers on how to accurately advertise broadband speeds to consumers. This update was prompted by NBN’s announcement of accelerated speed tiers that will be introduced in September 2025.
This submission recommends the ACCC:
Introduce an additional disclaimer alongside the statement in paragraph 3.25 to ensure consumers are informed that an upgrade of equipment is not necessary for the functionality of their broadband service.
Provide expanded guidance on reasonable steps RSPs can take to inform consumers about selecting and setting up their modem and other equipment.
Ensure the outline of best practice for advertising modems includes clear and prominent display of modem speed capabilities alongside pricing and features.
Provide additional guidance on principles for additional cost disclosure.
Update guidance on broadband tier labels to reflect market developments.
Provide guidance on the typical activities each speed tier can support.
